DISTANCE SALES AGREEMENT
ARTICLE 1: PARTIES
This agreement is made between TURİXA TURİZM SAN. TİC. LTD. ŞTİ., located at Arapsuyu Mahallesi 607 sok. No:24 /C-1 Konyaaltı, Antalya, Türkiye (hereinafter referred to as "TURAXUS TRAVEL" or "the Agency") and the individual making the reservation, whose address is specified above (hereinafter referred to as the "Reservation Holder," "Participant," "Guest," "Customer," or "Passenger"). The parties have reached a full agreement on the following terms and conditions.
ARTICLE 2: SUBJECT
This contract governs the services, including tour, hotel, or activity reservations and discounts, that the Customer receives or may receive from the Agency under the terms detailed herein.
ARTICLE 3: APPLICATION
3-1) Identification: For all domestic and international tours, participants are required to carry their national ID cards or passports. During the reservation process, participants must accurately and completely provide their date of birth, Turkish ID number (T.C. Kimlik No), and contact information. The participant is solely responsible for any penalties or consequences arising from providing incorrect information.
3-2) Air Travel: The Reservation Holder acknowledges and accepts that flight times and aircraft types may be subject to change by the airline. It is understood that specific warnings and information regarding this matter have been provided during the execution of this contract.
3-3) Departure Times: For tours that include transportation, participants must be at the designated meeting point for bus travel at least thirty minutes before departure and for air travel at least two hours before departure. Participants are not permitted to request disembarkation at locations other than those specified. Failure to arrive at the departure point on time will result in forfeiture of the right to a refund. In such cases, the participant may join the tour at a later point at their own expense and discretion.
3-4) Consent to Data Use: Participants on the tour are deemed to have consented to the use of their evaluations and comments provided in post-tour survey forms. Furthermore, they are deemed to have given explicit permission for promotional emails and SMS messages from TURAXUS TRAVEL. The participant also agrees that the Agency is authorized to collect, record, store, preserve, modify, rearrange, classify, and audit all data provided or transferred for the purpose of fulfilling the service, and to share this data with regulatory bodies or assignees exclusively for the performance of the contractual services, in compliance with all relevant legislation.
3-5) Triple Occupancy: The third-person discounts for triple occupancy hotel rooms are valid on the condition that they are accommodated in a triple room. However, the third bed is not guaranteed to be a standard bed and may be an extra or rollaway bed. The Reservation Holder is deemed to have accepted this condition.
3-6) Child Discounts: Child age discounts are applicable only when a minimum of two adults are present in the room. If only one adult is present, the child is charged at the rate of a second adult.
3-7) Vehicle Type and Seating: Transportation is provided by private vehicles, minibuses, or buses with varying capacities (2, 8, 16, 21, 50 people), depending on the group size. The Agency reserves the right to change the vehicle type based on road conditions or group size. Seating preferences (aisle/window) are not guaranteed, and the Agency reserves the right to change seat numbers if the vehicle type is altered.
3-8) Tour Cancellation by the Agency: The Agency reserves the right to cancel a tour if the minimum required number of participants is not met, due to a force majeure event, or if other unforeseen circumstances negatively impact the quality, safety, or flow of the tour. In such an event, the Agency will notify the Reservation Holder, and all payments made will be fully refunded using the original payment method (cash for cash payments, credit card for credit card payments, etc.). The Agency is not liable for any delays in credit card refunds, as this is subject to the operations of the relevant bank.
3-9) Itinerary Changes: TURAXUS TRAVEL reserves the right to make necessary changes to the tour content, date, or itinerary as advertised in brochures, on its website, social media, and other media. The Agency may alter the hotel, tour sequence, guide, vehicle, restaurants, menus, or add/cancel routes, provided that the service standards remain consistent. These changes may be made before or during the tour, and the guide is authorized to make such adjustments with the Agency's approval.
3-10) Participant-Initiated Cancellation due to Justifiable Reasons: If a Reservation Holder or a first-degree relative is unable to participate in the tour due to a serious illness (documented by an official report from a full-fledged state hospital) or the death of a first-degree relative, the Reservation Holder may transfer or cancel the reservation. Written documentation of the reason is required for such a request, and a refund will be processed in accordance with the contract's refund terms.
3-11) General Cancellation Policy:

More than 30 days prior: A full refund of the contract fee will be provided to the Reservation Holder.

15-0 days prior: No refund will be provided for cancellations made within this period.
3-12) Early Booking Discounts:

To qualify for early booking discounts on domestic cultural tours, participants must pay a minimum of 40% of the discounted price at the time of booking. The remaining balance must be paid at least 40 days before the tour departure date.

Failure to pay the balance by the specified date will result in the price being adjusted to the current rate. If no discount campaign is active at that time, the Agency reserves the right to cancel the previously applied discount.

Participants who have paid the full balance at least 40 days in advance are entitled to an unconditional cancellation and full refund up to 30 days before the tour departure.

For early booking hotel reservations with travel cancellation insurance, the full reservation fee (excluding the insurance premium) is refundable if the cancellation is made at least 72 hours before the check-in date. Date change requests are subject to the hotel's availability and pricing on the new dates, and any price difference will be borne by the Guest.
3-13) Personal Belongings: The Reservation Holder is responsible for the safekeeping of their personal belongings. The Agency is not liable for any lost, stolen, or misplaced items unless gross negligence by the Agency or its employees is proven. In such a case, the Agency's liability is limited to a maximum of 15% of the per-person tour price. The Agency is not responsible for items forgotten in the tour vehicle. The cost of returning any found items will be borne by the passenger.
3-14) Child Accommodations: If the declared ages of children benefiting from free or discounted stays are found to be incorrect, the Reservation Holder must immediately pay the full, correct amount. Participants are required to stay in the room type they booked and cannot request a different room type upon check-in. The Reservation Holder is deemed to have accepted the possibility of congestion in rooms shared with two or more children. The use of hotel services is at the discretion of the participant, and the Agency is not liable for any additional fees charged by the hotel for such services.
3-15) Third-Party Participants: By signing this contract, the Reservation Holder confirms that they have the authority to make reservations on behalf of all other participants listed in the contract. All other participants are deemed to have accepted and agreed to comply with all terms and conditions of this contract.
3-16) Participant Conduct: The Reservation Holder agrees to comply with the rules announced by the Agency, guide, and facility staff, to respect the peace and property of other participants, and to not engage in disruptive behavior. In the event of such behavior, the participant may be removed from the tour without any right to a refund or compensation.
3-17) Tour Program and Information: The Reservation Holder acknowledges that they have received and reviewed the tour program and brochure, and that all details regarding the tour have been provided to them. The participant is responsible for being fully informed about the purchased tour program and agrees that the tour content, route, and menus are as specified in the provided materials. Participants are not entitled to unilaterally request changes to the tour program. Any changes must be mutually agreed upon by all participants, and the tour guide is the authorized person to approve or deny such requests with the Agency's consent.
3-18) Travel to Georgia: A valid photo ID card with a Turkish ID number is required for entry into Georgia, including for infants. IDs older than 10 years, worn-out IDs, or those with an unreadable cold seal are not valid. The Reservation Holder is solely responsible for any issues or delays arising during the border crossing. The Agency is not liable for delays caused by congestion at border gates or tourist centers during peak seasons, national holidays, or festivals.
3-19) Hotel Room Allocation: The Agency has no direct control over the specific room allocated by a hotel, as this is managed by the facility. Therefore, the Agency cannot be held liable for the room assigned.
3-20) International Tours and Visas: A valid passport is required for all international tours, including for infants. Visa and passport procedures are the sole responsibility of the Reservation Holder. The Agency is not liable for any visa fees paid to an embassy if a visa is denied. For international tours sold by the Agency as a representative of other operators, the terms and conditions of the third-party operator will apply and will be provided for the participant's review and approval.
3-21) Agency's Liability: If the Agency fails to fulfill the tour contract due to its fault, or if the tour cannot be completed or is found to be deficient after it has started, the Agency will refund and compensate the participant in accordance with the provisions of the travel insurance.
3-22) Customer Complaints and Early Departure: If the Reservation Holder wishes to abandon the tour due to a perceived defect in the service, they must notify both the Agency and the facility in writing, stating their reasons, before leaving. Failure to do so will be considered as having received and used the service in full. A customer who uses the service to its fullest extent without making a written complaint to the Agency waives their right to compensation. The Agency reserves the right to investigate and respond to any complaints. If a guest makes public statements that damage the Agency's brand or reputation without first providing written notification and allowing the Agency to address the issue, the Agency reserves the right to seek legal remedies, including demands for a public retraction and compensation.
3-23) Mandatory Travel Insurance: For package tours purchased under Law No. 1618, the insurance covers situations where the tour is not provided or is provided incompletely, including the bankruptcy of the Agency. Coverage is limited to the package tour price.
3-24) Dispute Resolution: Disputes arising from this contract may be referred to the TURSAB Arbitration Board or other relevant legal bodies.
3-25) Final Agreement: The issued voucher and the attached registration form constitute the entire contract. By making this reservation, the Reservation Holder confirms that they have read, understood, and accepted all terms of this agreement.
3-26) Confirmation of Terms: Even if the customer cannot physically sign this contract due to purchasing via mail order, virtual POS, money transfer, or EFT, they are deemed to have learned and accepted the terms and conditions through the catalog, website, or advertisements.
3-27) Customer Due Diligence: The Customer agrees to read and sign this contract after having obtained all necessary information about the hotel, tour, and program from the Agency's website and sales representatives, and after conducting all required reviews.
3-28) Accommodation Standards: The Agency advertises the star ratings and features of accommodation facilities based on the information provided by the facilities themselves, in their brochures, and on their official websites. The Agency is not liable for any discrepancies between the advertised standards and the actual service provided, as this is the exclusive responsibility of the accommodation facility. In cases where the facility fails to meet the specified standards, the Agency reserves the right to accommodate the customer in a different facility of equal or higher standard.
3-29) No-Show and Early Check-Out: The accommodation fee is non-refundable if the hotel is not checked into without a prior cancellation. In the event of a documented force majeure (death, illness, or accident), a refund will be provided for the unused period. For late check-in or early check-out for any other reason, no refund will be provided for the remaining time.
3-30) No-Show for Tours: If a participant fails to arrive at the designated tour departure point on time without prior cancellation, the tour fee will not be refunded. Participants are responsible for being present at the announced time, date, and location.
3-31) Force Majeure by State Authority: In the event of a state-imposed travel ban, curfew, or state of emergency, the tour fee will be refunded to the participant within two months of the lifting of these restrictions. The refund will cover the full amount paid, excluding any non-refundable fees (taxes, duties, etc.) that have been paid to third parties and can be documented.
3-32) Payment Terms: Participants must pay at least 35% of the reservation fee at the time of booking, with the remaining balance due no later than 15 days before the service begins. Failure to make payments within these periods will result in the cancellation of the reservation, and 35% of the service fee will be charged as a cancellation penalty. Participation is not guaranteed for guests who have not paid the full amount by the specified deadline.
3-33) Campaign Policies: The Agency may launch early booking or other discount campaigns. It reserves the right to determine the discount rates and duration, and to cancel a campaign if deemed necessary. The Agency is not obligated to refund any price differences that may arise from subsequent promotional campaigns.
3-34) Travel Insurance Coverage: The scope of coverage for travel insurance is determined by the policy of the insurance company. The Agency holds no responsibility for the content or application of these guarantees.
3-35) Baggage Handling: In cases of lost or damaged baggage during air travel, the policies of the relevant airline company apply. The participant explicitly accepts that the Agency is not responsible for such incidents.
3-36) Early Departure: A customer's request for early departure from the tour or activity must be submitted in writing, with reasons, to both the Agency and the tour provider for evaluation. Refunds for early departure are at the discretion of the provider, and the Agency is not liable for any decisions made. Any penalties applied will be billed as accommodation fees.
3-37) Complaint Procedure: The customer must first address any dissatisfaction with the hotel or facility directly with the management. The hotel/facility is the primary opposing party in any subsequent legal action. The customer may not seek material or moral compensation from the Agency.
3-38) Travel Insurance: Mandatory travel insurance applies to domestic tours with accommodation. For daily tours or international tours, insurance is the responsibility of the guests. The insurance coverage is limited to the tour dates and ends at the conclusion of the tour. The participant is responsible for determining the scope of mandatory travel insurance.
